Will Moorhead City Council Defy MN Governor Dayton and State Law?

Trouble brewing in Moorhead and Fargo/Cass pressure is on! Although the resolution alleges “No Minnesota funds from the City of Moorhead or Clay County are required for FY2015, and a formal amendment to the LJPA is also not necessary at this time.” The Limited Joint Powers Agreement Article IX (read more…) suggests that Minnesota could be sued by North Dakota for not paying its budget share of what it is approving.

This is a federal project designed to have federal participation, but the federal government has no money. The continuing budget resolution funding the government in Washington has had a ban on new project construction funding for the last four years, with no end in sight. If you read the letter to the White House from the Minnesota governor, you’ll see he is requesting that no money or support be given to the diversion project, at least until the DNR is done with their study.

MN Gov Mark Dayton Expresses Strong Concerns About Fargo Diversion Authority Project

The Diversion Authority began construction of the Oxbow-Hickson-Bakke ring levee (Ring Levee) in North Dakota this past June. Given that land’s elevation, it is highly unlikely that this levee has independent utility separate from construction of the overall Project. Thus, construction of the Ring Levee, prior to completion of Minnesota’s EIS, violates our state’s law. Given the express commitments made by the Corps to Minnesota during the federal environmental review process and in the Chiefs Report, it is unacceptable that federal funding should be appropriated for the Fargo-Moorhead Project, or that construction should be allowed to begin prior to completion of Minnesota’s environmental review.
