Seated next to the Diversion Authority’s attorney in the courtroom was an attorney representing the Army Corps, aka, the United States Government. In discussions with the judge, the Army Corps attorney stated that federal law overrules state law only if it is a navigation project. This isn’t that type of project. Which, of course, means it’s a flood control project and states have as much right to control flood control projects as the feds do.

Breaking News: JPA Seeks Judgement Against OHB Ring Dike

Breaking News: The Richland-Wilkin Joint Powers Authority has directed its attorneys to seek an injunction in federal court halting
the ring dike project around Oxbow, Bakke and Hickson designed by the United States Army Corps of Engineers and which is a component of the Fargo-Moorhead Metropolitan Area Flood Risk Management Project.

Is the USACE an Accomplice in Fargo ND Land Grab? There are approximately 20,000 acres of land within Tiers 1 and 2 of Fargo’s development plan. Of this land, approximately 14,000 acres is within the present 100-year floodplain. Against FEMA warnings of flood plain encroachment, Fargo and Cass County ND continue their land grab in violation of ND Law and Executive Order 11988.
