This is a new tactic and was prompted perhaps by Fargo’s tardy realization that the project will not survive Minnesota’s permitting process. The State of Minnesota now needs to defend its laws and its citizens from Fargo’s development plan. The simple fact is that if upstream retention, as has been laid out by the various publicly funded organizations, had been in place in ’09, the biggest flood in recorded history would have been approximately 3 feet lower.
